Minimum $112.00 Fine (Includes Court Costs) – Drivers to exercise care. Notwithstanding other provisions of this chapter or the provisions of any local ordinance, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person. For Pedestrians
Minimum $112.00 Fine (Includes Court Costs) – Pedestrian obedience to traffic-control devices and traffic regulations. (a) A pedestrian shall obey the instructions of any official traffic-control device specifically applicable to him, unless otherwise directed by a police officer. (b) Pedestrians shall be subject to traffic and pedestrian control signals as provided in Sections 32-5A-32 and 32-5A-33. (c) At all other places, pedestrians shall be accorded the privileges and shall be subject to the restrictions stated in this chapter. Section 32-5A-210 (Acts 1980, No. 80-434, p. 604, §5-101.)
 
Minimum $112.00 Fine (Includes Court Costs) – Pedestrians’ right-of-way in crosswalks. (a) When traffic-control signals are not in place or not in operation the driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger. (b) No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close as to constitute an immediate hazard. (c) Subsection (a) shall not apply under the conditions stated in Section 32-5A-212(b). (d) Whenever any vehicle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching from the rear shall not overtake and pass such stopped vehicle. Minimum $112.00 Fine (Includes Court Costs) – Crossing at other than crosswalks. (a) Every pedestrian crossing a roadway at any point other than within the marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway. (b) Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right-of-way to all vehicles upon the roadway. (c) Between adjacent intersections at which traffic-control signals are in operation pedestrians shall not cross at any place except in a marked crosswalk. (d) No pedestrian shall cross a roadway intersection diagonally unless authorized by official traffic-control devices; and, when authorized to cross diagonally, pedestrians shall cross only in accordance with the official traffic-control pertaining to such crossing movements. Minimum $112.00 Fine (Includes Court Costs) – Pedestrians on roadways. (a) Where a sidewalk is provided and its use is practicable, it shall be unlawful for any pedestrian to walk along and upon the adjacent roadway. (b) Where a sidewalk is not available, any pedestrian walking along and upon a highway shall walk only on a shoulder, as far as practicable from the edge of the roadway. (c) Where neither a sidewalk nor a shoulder is available any pedestrian walking along and upon a highway shall walk as near as practicable to an outside edge of the roadway, and if on a two-way roadway, shall walk only on the left side of the roadway. (d) Except as otherwise provided in this chapter, any pedestrian upon a roadway shall yield the right-of-way to all vehicles upon the roadway. Minimum $325.00 Fine (Includes Court Costs) – Pedestrians under the influence of alcohol or drugs. A pedestrian who is under the influence of alcohol or any drug to a degree which renders himself a hazard shall not walk or be upon a highway. Minimum $112.00 Fine (Includes Court Costs) – Bridge and railroad signals. (a) No pedestrian shall enter or remain upon any bridge or approach thereto beyond the bridge signal, gate or barrier after a bridge operation signal indication has been given. (b) No pedestrian shall pass through, around, over or under any crossing gate or barrier at a railroad grade crossing or bridge while such gate or barrier is closed or is being opened or closed. $25.00 Fine (First Offense) (Includes Court Costs) – All walkers or joggers running or walking during hours of darkness must wear reflective material between the waist and shoulders on their front and back that gives an indication of the walker’s or jogger’s presence through reflected light from the head lamp beams of motor vehicles at a distance of a minimum of five hundred (500) feet. A citation for the first offense may be waived pursuant to the offender's purchase and installation (if appropriate) of reflectors or reflective clothing within forty-eight (48) hours of the offense and proof of purchase (materials and receipt) is presented to the citing officer within forty-eight (48) hours. For Cyclists
Minimum $112.00 Fine (Includes Court Costs) - Traffic laws apply to persons riding bicycles. Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by this chapter, except as to special regulations in this article and except as to those provisions of this chapter which by their nature can have no application. Minimum $112.00 Fine (Includes Court Costs) - Riding on bicycles. (a) A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached thereto. (b) No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. No person riding upon any bicycle, coaster, roller skates, sled or toy vehicle shall attach the same or himself to any vehicle upon a roadway. Minimum $112.00 Fine (Includes Court Costs) - Riding on roadways and bicycle paths. (a) Every person operating a bicycle upon a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. (b) Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles. (c) Wherever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway. No person operating a bicycle shall carry any package, bundle or article which prevents the driver from keeping at least one hand upon the handlebars. Minimum $112.00 Fine (Includes Court Costs) - Lamps and other equipment on bicycles. (a) Every bicycle when in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front and with a red reflector on the rear of a type approved by the department which shall be visible from all distances from 100 feet to 600 feet to the rear when directly in front of lawful lower beams of head lamps on a motor vehicle. A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to the red reflector. (b) Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheels skid on dry, level, clean pavement. A citation for the first offense may be waived pursuant to the offender's purchase and installation (if appropriate) of reflectors or reflective clothing within forty-eight (48) hours of the offense and proof of purchase (materials and receipt) is presented to the citing officer within forty-eight (48) hours. Minimum $145.00 Fine (Includes Court Costs) – It shall be unlawful for any person to ride a bicycle on the sidewalks in the Downtown Business District of the City of Auburn, Alabama. Ordinance #988. September 19, 1979.
